These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Axxa Media, LLC ("Axxa Media," "we," "us," or "our"), governing your access to and use of the K9ScanAI mobile application, web services, APIs, and canine care tools (collectively, the "Service").

By downloading, installing, accessing, or using K9ScanAI, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must immediately cease use and uninstall the application.

K9ScanAI is intended for users who are at least 13 years of age (or the minimum legal age of digital consent in your jurisdiction).

Users between 13 and the age of majority (typically 18) must possess the consent and supervision of a parent or legal guardian who agrees to these Terms on their behalf. Use by individuals under 13 is strictly prohibited.

Creating a personal account allows you to maintain "My Pack" canine profiles, save scan history, and synchronize subscription benefits across your devices. We use third-party authentication and identity management services to help secure user accounts, verify identities, and manage authenticated sessions.

A. Accurate Account Information:
You agree to provide true, accurate, current, and complete registration information and to promptly update your account details to maintain their accuracy. Providing false, misleading, or deceptive information constitutes a material breach of these Terms.

B. Responsibility for Credentials:
You are solely responsible for maintaining the confidentiality and security of your account login credentials, passwords, session tokens, and multi-factor authentication codes. You accept full responsibility for all activities, commands, profile modifications, and purchases conducted under or through your account credentials.

C. Account Sharing & Transfer Restrictions:
Accounts are granted strictly for your personal, individual, and non-commercial use. You may not sell, lease, transfer, assign, share, or pool account access, credentials, or subscription entitlements with third parties without prior written authorization from Axxa Media.

D. Unauthorized Access Reporting & Support Procedures:
You agree to notify Axxa Media immediately at [email protected] upon discovering, suspecting, or becoming aware of any unauthorized access to your account, credential exposure, or any other breach of security. Upon receipt of such notice, Axxa Media will initiate security incident support procedures, including terminating compromised sessions, invalidating active access tokens, and assisting you with account verification and credential recovery.

E. Exceptions to User Responsibility:
Notwithstanding the foregoing, you will not be held liable or responsible for unauthorized account activity or security incidents to the extent such access directly and demonstrably results from Axxa Media's internal technical vulnerabilities, systemic platform security breaches, or failure to maintain reasonable administrative, physical, or technical security safeguards in violation of applicable data protection laws.

All intellectual property rights in K9ScanAI—including but not limited to the multi-class canine classifier, 625-breed curated knowledgebase, morphological reasoning algorithms, user interface designs, and brand trademarks—are owned by Axxa Media, LLC or its licensors.

Axxa Media grants you a personal, non-exclusive, non-transferable, revocable license to install and use K9ScanAI on your personal mobile devices for non-commercial canine identification and pet care management.

K9ScanAI employs computer vision, machine learning models, and multimodal recognition systems to analyze canine photographs and predict potential breed matches against an extensive catalog of 625 recognized canine breeds, regional varieties, and landraces.

Third-Party AI Technology Services & Provider Neutrality:
AI capabilities within K9ScanAI are powered by automated analysis, generative AI, and third-party AI technology services hosted on external processing infrastructure. Axxa Media does not operate exclusively with any single AI provider and may update, transition, augment, or alternate between underlying AI technologies, models, and external vendors over time without altering the fundamental informational nature of the Service.

You acknowledge and understand that:

1. AI Breed Predictions are Visual Estimations: The classifier analyzes morphological features (head structure, skull shape, ear carriage, muzzle proportions, coat texture, and color patterns).
2. Mixed-Breed Uncertainty: In cross-bred or mixed-heritage dogs, visual traits often do not correlate directly with genetic composition. Dominant or recessive genetic traits may mask primary ancestral breeds, or simulate traits of unrelated breeds.
3. Photographic Variables: Lighting, camera resolution, perspective angle, animal posture, grooming styles, wet coats, and dog age (e.g., puppies lacking mature adult morphology) directly influence classification accuracy.
4. Confidence Percentages: Displayed confidence percentages represent statistical model ranking and comparative feature alignment, not biological certainty.

READ THIS CRITICAL SECTION CAREFULLY. IT DEFINES THE STRICT LEGAL BOUNDARIES OF THE SERVICE.

A. NON-EQUIVALENCE TO GENETIC OR DNA TESTING: K9ScanAI IS NOT A DNA TEST, GENETIC ANCESTRY ASSAY, OR BIOLOGICAL PEDIGREE CERTIFICATION.

• Visual classification cannot determine genomic DNA percentages, chromosomal heritage, purebred authenticity, or parentage.
• Do NOT use K9ScanAI results for kennel club registrations (e.g., American Kennel Club [AKC], United Kennel Club [UKC], Fédération Cynologique Internationale [FCI]), legal breed certifications, dog adoption disputes, or compliance with breed-specific legislation (BSL) or municipal / housing / homeowners insurance breed restrictions.

B. VETERINARY CARE & MEDICAL LIMITATIONS: K9ScanAI, including the "Ask AI Vet & Cynologist" conversational assistant, nutritional feeding estimates, and wellness articles, is strictly an educational and informational tool.

• NOT A SUBSTITUTE FOR A LICENSED VETERINARIAN: K9ScanAI does NOT provide veterinary medical advice, clinical diagnoses, treatment prescriptions, surgical recommendations, or emergency animal triage.
• Professional Veterinary Relationship: Use of K9ScanAI does not establish a veterinarian-client-patient relationship (VCPR). NEVER disregard, delay, or modify veterinary treatment based on software output.

C. CANINE BEHAVIOR & OWNER RESPONSIBILITY:

• Generalized Behavioral Traits: Any descriptions of breed temperament, energy levels, guard instincts, child-friendliness, or aggression tendencies are broad statistical generalizations, not guarantees of individual dog behavior.
• Individual Variation: Every dog's behavior is uniquely shaped by genetics, early socialization, training, environmental stimuli, trauma, and physical health.
• Strict Owner Responsibility: You remain 100% legally and strictly responsible for controlling, training, supervising, and leashing your dog at all times. Axxa Media disclaims all liability for animal aggression, dog bites, personal injury, property damage, animal-on-animal altercations, or violations of local leash, licensing, and dangerous dog ordinances.

D. EMERGENCY PROTOCOL & TOXIC SUBSTANCE WARNINGS: If your dog exhibits signs of acute distress, trauma, poisoning, collapse, bloat (GDV), seizures, or has ingested toxic substances (including chocolate, xylitol, grapes, raisins, onions, garlic, macadamia nuts, lilies, rat poison / rodenticides, or human medications), do NOT consult the AI. IMMEDIATELY CONTACT:

• Your local emergency veterinary clinic or animal hospital.
• ASPCA Animal Poison Control Center: 1-888-426-4435 (Fee-based 24/7 hotline).
• Pet Poison Helpline: 1-855-764-7661 (Fee-based 24/7 hotline).

You retain copyright and ownership in photographs of dogs and pet health notes uploaded to "My Pack."

A. License Grant to Axxa Media:
By uploading imagery and profile data to K9ScanAI, you grant Axxa Media a worldwide, non-exclusive, royalty-free, transferable license to store, process, compress, cache, and analyze the imagery solely to provide breed classification, maintain your canine profiles, and operate and improve the Service.

B. Ownership Warranties & Privacy of Others: You represent and warrant that:

1. You own or possess all necessary rights, licenses, consents, and permissions to upload all submitted photographs and profile details.
2. Submitted photographs do not depict or reveal identifiable non-consenting human persons, private residential interiors of third parties without consent, or infringing copyrighted materials.
3. You will not upload photographs depicting animal cruelty, dog fighting, physical neglect, or graphic trauma.

K9ScanAI provides a Free tier (ad-supported with banner and interstitial ads) and a paid auto-renewing Premium subscription tier. Premium unlocks unlimited breed scans, unrestricted access to the complete 625-breed reference catalog, deep trait analytics, and complete ad removal.

In-App Billing:
All subscriptions and purchases are billed through the Apple App Store or Google Play Store, managed via third-party subscription management services. You may cancel auto-renewal in your device settings. All refund requests are subject strictly to Apple Inc. or Google LLC policies.

You strictly agree NOT to:

1. Use K9ScanAI in connection with any form of animal abuse, animal cruelty, illegal dog fighting, or dangerous unlawful breeding operations.
2. Reverse engineer, decompile, or extract the proprietary 625-breed database, classifier weights, or internal system prompts.
3. Deploy automated scrapers or bots against our backend services.
4. Upload photographs depicting animal abuse, severe injury, or non-canine offensive imagery.

K9SCANAI, ITS 625-BREED CLASSIFIER, "ASK AI VET & CYNOLOGIST" ASSISTANT, AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AXXA MEDIA, LLC AND ITS SUPPLIERS, LICENSORS, AND AI TECHNOLOGY PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

1. IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
2. ANY WARRANTY THAT BREED IDENTIFICATIONS, HEALTH SUMMARIES, FEEDING GUIDANCE, OR AI OUTPUTS WILL BE ACCURATE, COMPLETE, RELIABLE, OR FREE FROM CLASSIFICATION ERRORS.
3. ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, COMPATIBLE WITH ALL MOBILE HARDWARE, OR RESISTANT TO DATA LOSS, SCAN DESTRUCTION, OR TELECOMMUNICATION FAILURES.
4. ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

YOU EXPRESSLY ACKNOWLEDGE THAT COMPUTER VISION ACCURACY IS INHERENTLY PROBABILISTIC AND THAT YOU RELY ON THE SERVICE ENTIRELY AT YOUR OWN RISK.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AXXA MEDIA, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, INABILITY TO USE, OR RELIANCE UPON OUR APPLICATIONS, SERVICES, ARTIFICIAL INTELLIGENCE FEATURES, RECOMMENDATIONS, ANALYSES, OR GENERATED CONTENT.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM INACCURATE OR INCOMPLETE INFORMATION, SERVICE INTERRUPTIONS, LOSS OF DATA, LOSS OF PROFITS, OR THIRD-PARTY CONTENT, TO THE EXTENT SUCH EXCLUSIONS ARE PERMITTED BY APPLICABLE LAW.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

You agree to defend, indemnify, and hold harmless Axxa Media, LLC, its subsidiaries, affiliates, officers, directors, employees, contractors, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and reasonable attorney fees arising out of or related to:

1. Your access to or use of K9ScanAI, including reliance on visual breed classifications, behavioral summaries, or AI wellness suggestions;
2. Any canine bite, attack, property damage, leash law violation, or disturbance caused by your pet;
3. Your violation of these Terms, applicable animal welfare statutes, municipal pet laws, or third-party rights;
4. Any User Content uploaded through your account, including claims of copyright infringement or invasion of privacy; or
5. Any willful misconduct, gross negligence, or animal neglect committed by you.

DISPUTE RESOLUTION AND ARBITRATION

Informal Dispute Resolution:
Before initiating arbitration or small claims proceedings, users are provided a reasonable opportunity to contact Axxa Media at [email protected] to seek an informal resolution. Axxa Media will engage in good faith to resolve concerns promptly. This informal dispute resolution procedure does not impose a mandatory waiting period, nor does it suspend, shorten, or conflict with any applicable statutory deadline or mandatory consumer right.

To the extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules.

Arbitration shall be conducted remotely, by telephone, through written submissions, or at a location determined in accordance with the applicable AAA rules and consumer protections.

These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer protection laws require otherwise.

Nothing in this provision shall prevent either party from pursuing claims in small claims court where permitted by applicable law or exercising rights that cannot lawfully be waived.
